Court Reaffirms Abiya as Kano NNPP Chairman…

Orders Dungurawa to stop parading him self, awards cost of N500, 000 in favour of Abiya
Kwankwaso loses hold in Kano NNPP as second option if ADC remains in crisis.
A Kano high court has nullified the dissolution of state leadership of New Nigerian Peoples Party (NNPP), affirming Abdullahi Abiya as authentic Chairman of the party in Kano.
The court held that the National Working Committee NWC of the party acted outside the powers conferred by its constitution and improperly relied on its provisions to carry out a blanket dissolution without the involvement of the National Executive Committee (NEC).
Abiya had dragged the NNPP National Working Committee (NWC) before Justice Nasiru Saminu challenging the dissolution of the party leadership in Kano without fair hearing. Abiya also sued Hashimu Suleiman Dungurawa, from parading himself as parallel chairman of the party in Kano.
In his judgement, Justice Saminu set aside the dissolution and granted a perpetual injunction restraining the party and its agents from interfering with the tenure of the duly elected State, Local Government, and Ward Executive Committees in Kano State.
Justice Saminu equally uphold the expulsion of Senator Rabiu Musa Kwankwaso’s anointed candidate Hon. Hashimu Suleiman Dungurawa from NNPP as declared by his Gargari ward and ratified by Dawakin-Tofa council and state executive council of the party. The court held that the expulsion from NNPP are valid, lawful and in full compliance with the party’s Constitution.
In the order, the court restrained Kwankwaso’s ally, Dungurawa, “whether by himself, his agents, privies, servants or any person acting through or under him, from further parading himself as the Kano State Chairman of the New Nigeria People’s Party (NNPP) or performing any functions attached to that office”.
Abiya had sought the relief for the court to declare “that the purported dissolution of the duly elected Kano State, Local Government and Ward Executive Committees of the New Nigeria People’s Party (NNPP) by the Defendant, acting through its National Working Committee, is ultra vires, unconstitutional, null and void, same having been carried out outside the powers conferred by Article 10.3 of the Constitution of the New Nigeria People’s Party (NNPP).
“A DECLARATION that the Defendant’s reliance on Article 10.3(e) of its Constitution to effect a blanket dissolution extending to Local Government and Ward Executive Committees, and without the involvement of the National Executive Committee (NEC), constitutes an abuse of discretionary power, and is therefore unlawful, ultra vires and void ab initio.
“A Declaration that the dissolution of the duly elected Kano State, Local Government and Ward Executive Committees of the Defendant without notice, hearing, or opportunity to be heard violates the Plaintiffs’ right to fair hearing guaranteed under section 36(1) of the Constitution of the Federal Republic of Nigeria, 1999 (as amended), Article 18(12) of the defendants constitution (as amended) is unconstitutional, unlawful, null and void.
“A DECLARATION that any action taken by the Defendant, its organs, agents, committees or privies pursuant to or founded upon the said purported dissolution is illegal, ineffective and of no legal consequence whatsoever.
“AN ORDER setting aside the purported dissolution of the State, Local Government and Ward Executives of the New Nigeria People’s Party (NNPP) in Kano State by the National Working Committee of the Defendant made on the 2nd day of January, 2026 having been made in excess of the defendant’s powers and in breach of the plaintiff’s right to fair hearing.
“AN ORDER OF PERPETUAL INJUNCTION restraining the defendant either by itself, assigns or privies from unlawfully dissolving, truncating or in any manner whatsoever interfering with the plaintiff’s tenure as duly elected members of Executive Committees of the defendant at the State, Local Governments and Wards levels in Kano State”.
Justice Saminu granted all the reliefs sought by Abiya. The court subsequently awarded the cost of ₦500,000 against Dungurawa and NWC.
